The Department of Veterans Affairs has halted the killing of unborn babies in abortions at its facilities nationwide, complying with a Justice Department opinion that restores longstanding federal prohibitions on taxpayer-funded abortions for veterans.

The reversal, effective immediately, overturns a 2022 Biden administration policy that had expanded abortion access within the VA system, allowing VA doctors to perform abortions even in violation of federal law and state protections for the unborn.

VA officials described the Biden-era change as politically motivated, marking a departure from precedents upheld across Democratic and Republican administrations.

“Prior to the Biden administration’s politically motivated change in 2022, federal law and longstanding precedent across Democrat and Republican administrations prevented VA from providing abortions and abortion counseling,” VA spokesperson Pete Kasperowicz said.

The DOJ opinion, issued last year under President Donald Trump, withdrew a 2022 Biden-era interpretation that had claimed authority for the VA to provide abortion services. Deputy Assistant Attorney General Josh Craddock wrote that existing law “unambiguously commands that VA may not provide abortions when furnishing medical care under 38 U.S.C. § 1710 or any other provision in chapter 17 of Title 38.”

Craddock added: “Nothing about our interpretation of section 106 undermines VA’s authority to provide infertility services or authorized pregnancy care, however.”

The policy shift aligns with the 1992 Veterans Health Care Act, which mandates general reproductive health care for female veterans but expressly prohibits abortions except in cases relating to pregnancies complicated by service-connected conditions.

A DOJ memo affirmed: “It is without question that VA has the authority to bar provision of abortion services through the VA medical benefits package to veterans.”

The Trump administration had signaled the change earlier, publishing a proposed rule in August 2025 to rescind the Biden policy, which turned VA clinics and hospitals into abortion centers despite federal law explicitly excluding abortions from covered services.

That Biden rule violated longstanding prohibitions on using taxpayer dollars for abortions, requiring funding for procedures under a broad health exception and authorizing payments for elective abortions regardless of state restrictions.

Pro-life advocates hailed the reversal as a victory for the unborn and a restoration of legal and moral order.

SBA Pro-Life America President Marjorie Dannenfelser said: “We thank President Trump and VA Secretary Collins for restoring the rule of law and ending the Biden Administration’s illegal policy that forced taxpayers to fund abortions through VA hospitals and violated state pro-life laws.”

Dannenfelser added: “Instead of prioritizing the real and urgent needs of our veterans, the Biden-Harris Administration turned VA hospitals into abortion centers – violating longstanding law and betraying the will of the American people who strongly oppose forced taxpayer-funded abortions. Veterans deserve compassionate care and healing and should not be subjected to the violence of abortion. The American people should never have been made to bankroll it. Thankfully this injustice is now corrected.”

The Biden policy, implemented after the Supreme Court overturned Roe v. Wade, had resulted in the deaths of dozens of unborn babies at VA facilities.

It also drew condemnation from religious leaders, including Catholic Archbishop Timothy Broglio, who in an April 2023 letter described the rule as “morally repugnant and incongruent with the Gospel which the faithful are commissioned to share throughout the world.”

Broglio further noted that the policy failed to incorporate basic conscience protections, creating First Amendment issues for military commanders and VA employees.

The VA’s decision affects a nationwide system serving more than 9 million enrolled veterans, limiting abortions to life-threatening medical emergencies.

The change restores the medical benefits package to its pre-2022 state, excluding abortions and most counseling since 1999.

“The Department of Justice last year issued an opinion that states VA is not legally authorized to provide abortions, and VA complied with that opinion immediately,” Kasperowicz said. “DOJ’s opinion is consistent with VA’s final rule on this matter.”

Attorneys general in 18 states had sued the Biden administration over the policy, arguing it violated state pro-life laws.

The Trump reversal ensures VA facilities no longer override such protections, prioritizing the lives of the unborn while providing authorized care to veterans.
