Some of the other Supreme Court decisions left a lot to be desired, so don&#8217;t fall for the trap of thinking that us citizens are winning quite yet.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.zerohedge.com\/political\/scotus-overturns-chevron-deference-massive-blow-administrative-state\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.zerohedge.com\/political\/scotus-overturns-chevron-deference-massive-blow-administrative-state<\/a><\/p>\n\n\n<div class=\"wp-block-ub-divider ub_divider ub-divider-orientation-horizontal\" id=\"ub_divider_84a1970a-36cd-4656-ab8e-8c6060528f7a\"><div class=\"ub_divider_wrapper\" style=\"position: relative; margin-bottom: 2px; width: 100%; height: 2px; \" data-divider-alignment=\"center\"><div class=\"ub_divider_line\" style=\"border-top: 2px solid #ccc; margin-top: 2px; \"><\/div><\/div><\/div>\n\n\n<p>by Tyler Durden<\/p>\n\n\n\n<p>The Supreme Court has ruled to overturn the so-called &#8216;Chevron Deference&#8217; dealing a huge blow to the so-called &#8216;administrative state&#8217; that [they] have enjoyed.<\/p>\n\n\n\n<p>In an 6-3 decision along ideological lines, the Supreme Court\u2019s conservative majority<strong> upended the 40-year administrative law precedent that gave agencies across the federal government leeway to interpret ambiguous laws through rulemaking<\/strong>.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter\"><img decoding=\"async\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/Leading-SupCrt_062724_AP_Mark-Sc.jpg?itok=UG9lfyaW\" alt=\"\"\/><\/figure>\n\n\n\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/Leading-SupCrt_062724_AP_Mark-Sc.jpg?itok=UG9lfyaW\"><\/a><\/p>\n\n\n\n<p><strong>Conservatives and Republican policymakers have long been critical of the doctrine, saying it has contributed to the dramatic growth of government and gives unelected regulators far too much power<\/strong> to make policy by going beyond what Congress intended when it approved various laws. The authority of regulatory agencies has been increasingly questioned by the Supreme Court in recent years.<\/p>\n\n\n\n<p>Those on <strong>the other side say the Chevron doctrine empowers an activist federal government to serve the public interest <\/strong>in an increasingly complicated world without having to seek specific congressional authorization for everything that needs to be done.<\/p>\n\n\n\n<p><a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4745680-supreme-court-chevron-case\/\">As The Hill report,<\/a> judges previously had to defer to agencies in cases where the law is ambiguous.<\/p>\n\n\n\n<p>Now, judges will substitute their own best interpretation of the law, instead of deferring to the agencies &#8211;<strong> effectively making it easier to overturn regulations that govern wide-ranging aspects of American life.<\/strong><\/p>\n\n\n\n<p>This includes rules governing toxic chemicals, drugs and medicine, climate change, artificial intelligence, cryptocurrency and more.<\/p>\n\n\n\n<p><strong>The move hands a major victory to conservative and anti-regulatory interests <\/strong>that have looked to eliminate the precedent as part of a broader attack on the growing size of the \u201cadministrative state.\u201d<\/p>\n\n\n\n<p>The Biden administration defended the precedent before the high court.<\/p>\n\n\n\n<p><a href=\"https:\/\/x.com\/mjs_DC\/status\/1806696021952442808\">As Mark Joseph Stern writes on X:<\/a><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em><strong>&#8220;Today&#8217;s ruling is a massive blow to the &#8216;administrative state&#8217;, <\/strong>the collection of federal agencies that enforce laws involving the environment, food and drug safety, workers&#8217; rights, education, civil liberties, energy policy\u2014the list is nearly endless.&#8221;<\/em><em>&#8220;The Supreme Court&#8217;s reversal of Chevron constitutes <strong>a major transfer of power from the executive branch to the judiciary, stripping federal agencies of significant discretion to interpret and enforce ambiguous regulations.<\/strong>&#8220;<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Chief Justice Roberts, writing the opinion of the court, argued Chevron &#8220;defies the command of&#8221; the Administrative Procedure Act, which governs federal administrative agencies.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>He said it &#8220;requires a court to ignore, not follow, &#8216;the reading the court would have reached had it exercised its independent judgment as required by the APA.'&#8221;<\/em><\/p>\n\n\n\n<p><strong><em>Further, he said it &#8220;is misguided&#8221; because &#8220;agencies have no special competence in resolving statutory ambiguities. Courts do.&#8221;<\/em><\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>The liberals on the court are not happy:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>&#8220;In dissent, Justice Kagan says the conservative supermajority &#8220;disdains restraint, and grasps for power,&#8221; making &#8220;a laughingstock&#8221; of stare decisis and producing &#8220;large-scale disruption&#8221; throughout the entire government.
