And of course, they&#8217;re about to be disciplined for going against the propaganda narrative. Credit to these two female judges for doing their jobs while showing great courage, as it will probably cost them their professions. This is a real legal drama verses the OCGFC show trial and conviction of Trump meant to spin up conservatives into overstepping (and remember Trump setup the Jan 6th protestors as he&#8217;s an actual member of the OCGFC playing a role while doing comedy sets at his campaign events).<\/p>\n\n\n\n<p><a href=\"https:\/\/www.portugalresident.com\/portuguese-judges-who-queried-reliability-of-covid-tests-at-risk-of-being-disciplined\/\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.portugalresident.com\/portuguese-judges-who-queried-reliability-of-covid-tests-at-risk-of-being-disciplined\/<\/a><\/p>\n\n\n<div class=\"wp-block-ub-divider ub_divider ub-divider-orientation-horizontal\" id=\"ub_divider_6434eb8d-174a-4fde-b181-22d251fa95eb\"><div class=\"ub_divider_wrapper\" style=\"position: relative; margin-bottom: 2px; width: 100%; height: 2px; \" data-divider-alignment=\"center\"><div class=\"ub_divider_line\" style=\"border-top: 2px solid #ccc; margin-top: 2px; \"><\/div><\/div><\/div>\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"694\" height=\"409\" src=\"https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/05\/image-27.png\" alt=\"\" class=\"wp-image-7467\" srcset=\"https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/05\/image-27.png 694w, https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/05\/image-27-300x177.png 300w\" sizes=\"auto, (max-width: 694px) 100vw, 694px\" \/><\/figure>\n\n\n\n<p>By Natasha Donn<\/p>\n\n\n\n<p>Two appeal court judges in Lisbon are at risk of being \u2018disciplined\u2019 for a 34-page ruling in which they justified their reasons for releasing four German tourists from confinement in the Azores <a href=\"https:\/\/www.portugalresident.com\/judges-in-portugal-highlight-more-than-debatable-reliability-of-covid-tests\/\">(click here)<\/a>.<\/p>\n\n\n\n<p>The Superior Council of Magistrature (SCM) will be \u2018appreciating\u2019 this matter (in other words, deciding whether the two judges should be \u2018disciplined\u2019) on December 2 (Wednesday).<\/p>\n\n\n\n<p>The social media movement Juristas Pela Verdade has organised a protest outside the SCM building in Lisbon from 9am on that day, describing the situation as \u201can attempt to destroy the rule of law in Portugal\u201d.<\/p>\n\n\n\n<p>This may sound like an \u2018academic issue\u2019 but it goes to the very heart of the current crisis: the fact that an official narrative appears to be the only one \u2018allowed\u2019, even for members of the judiciary who have studied scientific opinions in order to rule on appeals.<\/p>\n\n\n\n<p>In this case, the appeal was lodged by ARS dos A\u00e7ores \u2013 the regional health authority which disagreed with a lower court having granted a writ of Habeas corpus lodged by four German tourists held in a hotel because one of them had registered positive following a routine PCR test. None of the tourists showed any symptoms of Covid-19, but were held in isolation in their hotel for more than 10 days.<\/p>\n\n\n\n<p>The judges \u2013 Margarida Ramos de Almeida and Ana Param\u00e9s \u2013 went to great pains to assess whether or not there were indeed legal grounds for the tourists\u2019 enforced confinement. They decided there were not.<\/p>\n\n\n\n<p>It was illegal for ARS dos A\u00e7ores to hold the Germans outside the context of a State of Emergency \u2013 which wasn\u2019t in force at the time (August) \u2013 and the judges\u2019 deliberations over numerous pages minutely explained the form in which they had reached their conclusions.<\/p>\n\n\n\n<p>In this context, the judges stated that the PCR test could not be relied upon to give an accurate reading.<\/p>\n\n\n\n<p>Their reasoning stemmed from the fact that reliability depends always on the number of cycles (amplifications) involved in the test \u2013 which no one appeared to be certain of.<\/p>\n\n\n\n<p>Citing research published in the Oxford Academic, the judges explained that the number of amplifications used in many European labs meant that a positive PCR test could, in theory, have a 97% rate of fallibility.<\/p>\n\n\n\n<p>This wasn\u2019t something the judges \u2018made up\u2019: they were quoting from published research. They actually quoted two sources suggesting the \u2018gold standard PCR testing method\u2019 was open to recording false positives.<\/p>\n\n\n\n<p>Jornal de Not\u00edcias followed up on the decision suggesting the CSM \u2018understands\u2019 that the judges should not have come to the decision they reached.<\/p>\n\n\n\n<p>\u2018Specialists\u2019 accused the legislators of being wrong, and irresponsible \u2013 and now we are at the point where the various specialist opinions are to be weighed by the CSM against those proffered by two appeal court judges.<\/p>\n\n\n\n<p>Says Juristas pela Verdade in a post outlining Wednesday\u2019s protest, the judges\u2019 decision \u201cfell like a bomb on the official narrative, on the basis of which thousands of Portuguese have been ordered into house arrest\u201d.<\/p>\n\n\n\n<p>And it sees the CSM intervention as \u201cunacceptable interference by an administrative branch in a sovereign body of judicial power, aiming at control of the latter in what can only be characterised as a violent blow to the rule of law\u201d.<\/p>\n\n\n\n<p>Says the movement, the message to other courts is loud and clear \u201cconsequences may arise if they decide in the opposite direction to the official narrative\u201d.<\/p>\n\n\n\n<p>For citizens, \u201cit means they cannot count on the independence of the courts or judges\u201d.<\/p>\n\n\n\n<p>In Juristas pela Verdade\u2019s opinion the judges\u2019 assessment of this situation was not \u2018wrong\u2019 nor \u2018irresponsible\u2019, it was \u201cbrilliant and courageous\u201d. And for that reason the movement is asking as many people as possible to demonstrate outside the CSM building next Wednesday.<\/p>\n\n\n\n<p>\u201cCourts are the last stronghold for defending our rights before disruption\u201d, says the post that has been shared hundreds of times, and received numerous positive comments.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This is fabulous, in that two Portuguese judges looked into the science and accurately ruled that the PCR tests are only 3% accurate.
