So you have to assume they are purposely targeting children, as if you&#8217;ll notice up to now they pick high points for cellular installations for maximum coverage of an area. Originally they were talking about putting small cellular 200 watt installations throughout neighborhoods, and there was a story of <a href=\"https:\/\/jasonsblog.ddns.net\/index.php\/2023\/06\/29\/star-power-helps-malibu-residents-in-battle-over-5g-small-cell-transmitters\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mel Gibson and his neighbors<\/a> fighting these types of installations in Malibu. School boards often don\u2019t tell parents until after the deal is signed.<\/h6>\n\n\n\n<p>By Suzanne Burdick, Ph.D.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/telecom-cell-tower-deals-schools-feature-800x417.jpg\" alt=\"cell tower and boy wearing backpack\"\/><\/figure>\n\n\n\n<p><em><strong>Editor\u2019s note<\/strong>: This is the first in a series on how the wireless industry is targeting schools for wireless infrastructure installation. Part 1 covers the recent surge and why parents are fighting back.<\/em><\/p>\n\n\n\n<p>Telecommunications companies are targeting school properties as prime locations for installing cell towers, antennas and other wireless infrastructure \u2014 and many schools are taking the bait, said attorney <a href=\"https:\/\/www.denleacarton.com\/attorney\/robert-j-berg\/\">Robert Berg<\/a>.<\/p>\n\n\n\n<p>Berg represents parents in multiple lawsuits challenging proposals for <a href=\"https:\/\/childrenshealthdefense.org\/defender\/barbara-knudson-walla-walla-att-cell-tower-lawsuit\/\">cell towers<\/a> or wireless antenna placements at their kids\u2019 schools.<\/p>\n\n\n\n<p>He told <a href=\"https:\/\/childrenshealthdefense.org\/defender\/\">The Defender<\/a> that \u201cliterally hundreds\u201d of U.S. school boards have signed long-term leases with <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/big-tech\/\">telecom companies<\/a>.<\/p>\n\n\n\n<p>\u201cThe school board members think it\u2019s easy money,\u201d Berg said. The school leaders rent out bits of school property to the wireless companies \u2014 such as a small site next to an athletic field or space on the school roof \u2014 for a monthly fee.<\/p>\n\n\n\n<p>Many times school leaders have \u201cno idea what they\u2019re doing.\u201d<\/p>\n\n\n\n<p>\u201cThey lock themselves into bad contracts that can last for decades, at below market rate terms,\u201d Berg said. \u201cMeanwhile, the cell towers are irradiating all the kids, the staff and the teachers the entire school day, along with the surrounding neighbors 24\/7.\u201d<\/p>\n\n\n\n<p>Parents frequently don\u2019t learn of the deal until after it\u2019s been signed \u2014 and then it\u2019s too late, he said.<\/p>\n\n\n\n<p>One of Berg\u2019s cases involves what he called \u201ca nightmare scenario\u201d in <a href=\"https:\/\/www.wxyz.com\/news\/wyandotte-parents-file-lawsuit-against-school-board-mayor-over-cellphone-tower\">Wyandotte, Michigan<\/a>, where the school board, after literally 48 seconds of discussion, approved a contract with T-Mobile to pay the district $1,000 a month to operate a \u201cmassive array\u201d of wireless antennas on the chimney atop Washington Elementary School.<\/p>\n\n\n\n<p>Parents didn\u2019t find out until the antennas were being installed. They protested, but the school board and superintendent insisted the contract would not be broken.<\/p>\n\n\n\n<p>Parent dissatisfaction grew so great that the superintendent was forced to resign. The new superintendent asked T-Mobile to move the antennas to a district site \u2014 and the superintendent offered to build a taller cell tower for T-Mobile at the district\u2019s expense.<\/p>\n\n\n\n<p>T-Mobile refused.<\/p>\n\n\n\n<p>Several parents <a href=\"https:\/\/childrenshealthdefense.org\/defender\/wyandotte-washington-elementary-school-cell-tower-restraining-order\/\">sued to prevent T-Mobile from activating the antennas<\/a>. The parents initially succeeded in court, but then the court dismissed their suit and allowed T-Mobile to turn on the antennas.<\/p>\n\n\n\n<p>\u201cThe parents have appealed the decision,\u201d Berg said, \u201cbut in the meantime, parents of about 20% of the pre-antenna student population have pulled their kids from the school, many transferring them to other schools or districts, and some selling their homes and moving from the city.\u201d<\/p>\n\n\n\n<p>Jenny DeMarco, co-founder and communications director for<a href=\"https:\/\/virginiansforsafetech.org\/\"> Virginians for Safe Technology<\/a>, told The Defender she \u201caccidentally\u201d discovered that her kids\u2019 <a href=\"https:\/\/www.frestavalley.org\/\">private school<\/a> had been sited for a cell tower. \u201cThey never disclosed this to the parents who paid tuition.\u201d<\/p>\n\n\n\n<p>\u201cSo I ended up making flyers,\u201d she said. \u201cMy husband and I stood in the parking lot lines and handed out the flyers\u201d informing parents of the school\u2019s plans.<\/p>\n\n\n\n<p>Enough parents found out about the proposed cell tower, that school leaders were \u201cforced to address it,\u201d DeMarco said. Although the school administrator evaded DeMarco\u2019s attempts to determine if and when a contract was signed, the tower hasn\u2019t gone up.<\/p>\n\n\n\n<p>Now DeMarco is leading efforts to stop a <a href=\"https:\/\/www.fauquiernow.com\/news\/fauquier-school-board-hears-proposal-for-150-foot-telecommunications-tower-on-liberty-hs-property\/article_e87547a6-e182-11ee-9422-93eac84a2e9f.html\">cell tower slated to be built<\/a> at a local public high school and adjacent to a local public elementary school.<\/p>\n\n\n\n<p><strong>Wireless company denies health risks<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/milestonetowers.com\/\">Milestone Towers<\/a>, the wireless developer who wants to build the tower near the Virginia schools on March 14 told the <a href=\"https:\/\/go.boarddocs.com\/va\/fcps\/Board.nsf\/files\/D36TTP6F213E\/$file\/Liberty%20HS%20Presentation%203.14.24.pdf\">Fauquier County School Board<\/a> that it had developed \u201cover 100 towers on public school properties over 20+ years.\u201d<\/p>\n\n\n\n<p>The company promised board members the new tower would bring in $11,520 in annual revenue for the school district.<\/p>\n\n\n\n<p>The company\u2019s presentation failed to mention any research showing negative health <a href=\"https:\/\/childrenshealthdefense.org\/emr\/emf-wireless-health-impacts\/\">effects of wireless radiation<\/a> exposure, DeMarco said.<\/p>\n\n\n\n<p>Milestone Towers\u2019 one <a href=\"https:\/\/go.boarddocs.com\/va\/fcps\/Board.nsf\/files\/D36TTP6F213E\/$file\/Liberty%20HS%20Presentation%203.14.24.pdf\">slide on RF safety<\/a> said their towers \u201cmeet or exceed\u201d the U.S. Federal Communication Commission\u2019s (FCC) wireless radiation emission standards. \u201cBut that\u2019s not saying much because the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/fcc-limits-wireless-radiation-exposure-decades-out-of-date\/\">FCC\u2019s standards are decades old<\/a> and don\u2019t take long-term <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/toxic-exposures\/\">exposure<\/a> into account,\u201d DeMarco said.<\/p>\n\n\n\n<p>DeMarco said Milestone Tower, a major cell tower developer in her state, routinely denies health risks in its public presentations.<\/p>\n\n\n\n<p>She shared a clip of the company\u2019s founder and president, <a href=\"https:\/\/www.lenforkas.com\/about\/\">Len Forkus<\/a>, <a href=\"https:\/\/www.youtube.com\/watch?v=4QyEtcNdwoo\">telling a 5th grader<\/a> \u2014 who voiced concerns that she may one day get cancer if his company put a cell tower on her school \u2014 that there is no research linking cell tower radiation to cancer or other <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/health-conditions\/\">health problems<\/a>.<\/p>\n\n\n\n<p>\u201cThat\u2019s a lie,\u201d DeMarco said.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/ehtrust.org\/\">Environmental Health Trust<\/a>, a nonprofit scientific research and education group focused on the effects of wireless radiation, compiled many independent peer-reviewed studies showing serious <a href=\"https:\/\/ehtrust.org\/why-are-doctors-concerned-about-the-health-effects-of-wireless-and-cell-phones-in-schools\/\">harm to humans from exposure<\/a> to wireless radiation, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A <a href=\"http:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/15368378.2017.1350584\">2017 study<\/a> that found living near a cell tower was linked to blood changes, which are considered biomarkers predictive of cancer.<\/li>\n\n\n\n<li>A <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/30526242\/\">2018 study<\/a> that showed adolescents exposed to higher levels of wireless radiation had delayed fine and gross motor skills, spatial working memory and attention compared with those exposed to lower radiation levels.<\/li>\n\n\n\n<li>A <a href=\"https:\/\/ehtrust.org\/wp-content\/uploads\/ijerph-12-14519.pdf\">2015 study<\/a> that found higher rates of <a href=\"https:\/\/www.health.harvard.edu\/diseases-and-conditions\/type-2-diabetes-mellitus-a-to-z\">Type 2 diabetes mellitus<\/a> in elementary students exposed to higher levels of wireless radiation compared with those exposed to lower radiation levels.<\/li>\n<\/ul>\n\n\n\n<p>Even the telecom workers\u2019 union, <a href=\"https:\/\/cwa-union.org\/national-issues\/health-and-safety\/health-and-safety-fact-sheets\/microwave-and-radio-frequency\">Communications Workers of America<\/a>, warns workers that wireless radiation can cause sterility, eye damage, central nervous system harm and other \u201cserious biological effects.\u201d<\/p>\n\n\n\n<p>\u201cBut somehow Milestone Towers omits all this information from its public presentations,\u201d DeMarco said.<\/p>\n\n\n\n<p>Milestone Towers did not respond by deadline to The Defender\u2019s request for comment.<\/p>\n\n\n\n<p><strong>Where\u2019s the informed consent?<\/strong><\/p>\n\n\n\n<p>When cell tower companies like Milestone Towers don\u2019t tell school leaders about the risks students face from nearby cell towers, parents are denied informed consent, said Fauquier County Public Schools parent Jamie Hinkle.<\/p>\n\n\n\n<p>\u201cWhen it comes to schools,\u201d Hinkle \u2014 whose three daughters attended Fauquier schools \u2014 told The Defender, \u201cThere has to be informed consent. I want to know about the risks.\u201d<\/p>\n\n\n\n<p>School leaders need to educate themselves about the possible risks to kids\u2019 health and then provide that information to parents so parents can decide whether the risk is worth the money, she said.<\/p>\n\n\n\n<p>\u201cWe vote in these school board members to act on behalf of their constituents.\u201d<\/p>\n\n\n\n<p><strong>Wireless contracts lock in schools for decades<\/strong><\/p>\n\n\n\n<p>Most school leaders Berg has interacted with don\u2019t understand the terms of the leases offered by wireless companies.<\/p>\n\n\n\n<p>The board members think they\u2019re renting out school property for just a few years because the initial term is typically five years.<\/p>\n\n\n\n<p>\u201cBut the leases are renewable for additional five-year terms at the sole discretion of the lessee \u2014 meaning the cell tower company \u2014 so \u2026 they\u2019re often 30- or 35-year leases,\u201d Berg said.<\/p>\n\n\n\n<p>The cell tower company alone can cancel the lease, as long as the company pays the rent fee and maintains the wireless facility. \u201cThey\u2019re [the contracts] completely one-sided.\u201d<\/p>\n\n\n\n<p>Earlier in 2019, Fauquier\u2019s school board signed this type of lease with Milestone Towers to put a cell tower at a different local high school. A copy of the lease for the newly proposed tower is not publicly available, DeMarco said.<\/p>\n\n\n\n<p>DeMarco \u2014 who obtained the 2019 lease via the Freedom of Information Act \u2014 said the lease allows the company to operate its tower for 10 years with multiple five-year renewals.<\/p>\n\n\n\n<p>\u201cSo the school board won\u2019t be able to revisit the contract until the youngest kid at this high school is at least 45 years old,\u201d she said. \u201cIt\u2019s nuts.\u201d<\/p>\n\n\n\n<p>Berg, who analyzed the lease, said it was similar to what he\u2019s seen signed by other schools.<\/p>\n\n\n\n<p><strong>Talk to school leaders early<\/strong><\/p>\n\n\n\n<p>It\u2019s best if parents can <a href=\"https:\/\/childrenshealthdefense.org\/emr\/education\/\">inform school leaders<\/a> about the risks of wireless radiation before a telecom offer is on the table, Berg said.<\/p>\n\n\n\n<p>\u201cI\u2019ve been successful recently in a couple of instances in getting the boards to stop literally the night before the day they were going to sign the lease,\u201d Berg said. \u201cThey backed off because the parents got involved a week or two or a month before and said, \u2018Don\u2019t enter the lease.\u2019\u201d<\/p>\n\n\n\n<p>DeMarco and Hinkle are hoping that will happen in their community.<\/p>\n\n\n\n<p>The school board on May 13 voted on whether to build the new cell tower, but the <a href=\"https:\/\/www.fauquier.com\/news\/school-board-to-re-vote-on-liberty-high-cell-tower\/article_a62277aa-1195-11ef-9975-bb738dc30e32.html\">vote was a tie<\/a> (2-2) with one member absent.<\/p>\n\n\n\n<p>The full board will take another vote at their June 10 meeting.<\/p>\n\n\n\n<p>Meanwhile, parents have been emailing the boards saying they have safety concerns. More than 260 people have <a href=\"https:\/\/www.change.org\/p\/help-stop-the-installation-of-cell-phone-towers-at-liberty-high-other-fauquier-schools\">signed a petition against the new tower<\/a>.<\/p>\n\n\n\n<p>Berg said people need to understand that school leaders have a lot of power to stop wireless companies. \u201cThe school district is perfectly free to say, \u2018No, it\u2019s our property. We don\u2019t want it.\u2019\u201d<\/p>\n\n\n\n<p>State and county officials can\u2019t deny a wireless project application due to safety or health concerns \u2014 which are considered \u201c<a href=\"https:\/\/transition.fcc.gov\/Reports\/tcom1996.pdf\">environmental effects<\/a>\u201d under the <a href=\"https:\/\/www.fcc.gov\/general\/telecommunications-act-1996\">Telecommunications Act of 1996<\/a> \u2014 but that\u2019s not the case with school boards, he said.<\/p>\n\n\n\n<p>School leaders can consider any reason they wish, including concerns about health and safety.<\/p>\n\n\n\n<p>However, once school leaders sign a contract, it\u2019s legally much harder to stop a wireless building project.<\/p>\n\n\n\n<p>\u201cThat\u2019s why you\u2019ve got to get in early while you can present all that information to the board,\u201d he said. \u201cYou\u2019ve got to convince the boards of education that this is a really bad idea.\u201d<\/p>\n\n\n\n<p>Berg suggested parents give board members these three reasons:<\/p>\n\n\n\n<p>1. There is no conclusive evidence proving long-term exposure to wireless radiation is safe \u2014 and there are plenty of scientific studies linking wireless radiation with severe health risks to humans, especially children.<\/p>\n\n\n\n<p>\u201cAs fiduciaries whose primary responsibility is assuring the health and safety of those who use the schools, school board members should avoid intentionally exposing users of school property to continuous wireless radiation,\u201d Berg said.<\/p>\n\n\n\n<p>2. The lease likely isn\u2019t just a five- or 10-year lease. \u201cIt\u2019s a 35-year lease that the school district can\u2019t cancel.\u201d<\/p>\n\n\n\n<p>3. \u201cYou\u2019re tying up your ability to use that land for that period \u2014 and you\u2019re exposing your teachers, your students, your staff and visitors to the dangers of this wireless radiation for a tiny amount of money.
