And I <a href=\"https:\/\/jasonsblog.ddns.net\/index.php\/2022\/08\/17\/political-theater\/\" target=\"_blank\" rel=\"noreferrer noopener\">don&#8217;t trust our congress critter<\/a> quoted in the article, though her masters are allowing her to make a name for herself which is good up until the time they force her to fall on her sword. So is this a distraction and a hollow victory while they get the FISA legislation through the Senate to be signed by puppet Biden? And notice how they&#8217;re just restricting the government&#8217;s purchasing of the data, but not doing a thing about the data being collected by third parties. Consequently, even if they can&#8217;t buy it, they can steal it with their army of hackers who pay for new exploits which can&#8217;t be revealed publicly. Harriet Hageman said.<\/h5>\n\n\n\n<p>By Andrew Thornebrooke<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/04\/image-9-1024x683.png\" alt=\"\" class=\"wp-image-7068\" srcset=\"https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/04\/image-9-1024x683.png 1024w, https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/04\/image-9-300x200.png 300w, https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/04\/image-9-768x512.png 768w, https:\/\/jasonsblog.ddns.net\/wp-content\/uploads\/2024\/04\/image-9.png 1080w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>The House on passed a bill on April 17 that would require the federal government to obtain a warrant to purchase Americans\u2019 private data from third parties.<\/p>\n\n\n\n<p>HR 4639, \u201cThe Fourth Amendment is Not for Sale Act\u201d (FANSA), would amend the U.S. code to clarify that the Fourth Amendment applies to information obtained through commercial means in addition to traditional searches.<\/p>\n\n\n\n<p>In other words, it would ban the U.S. government from purchasing Americans\u2019 private data without a warrant.<\/p>\n\n\n\n<p>The bill passed in a bipartisan 219 to 199 vote. 123 Republicans and 96 Democrats voted for the bill; 109 Democrats and 90 Republicans voted against it.<\/p>\n\n\n\n<p>The bill is critical piece of ongoing negotiations to extend authorization for the controversial Section 702 of the Foreign Intelligence Surveillance Act, which effectively allows the government to spy on American citizens if those citizens have communicated with someone outside the country.<\/p>\n\n\n\n<p>\u201cThis bill is exactly the type of legislation needed to rein in the federal government and protect the privacy rights of Americans,\u201d Ms. Hageman said.<\/p>\n\n\n\n<p>\u201cInstead of going to a judge to demonstrate probable cause and obtain a warrant, government agencies like the Federal Bureau of Investigation, the Internal Revenue Service, the Drug Enforcement Agency, and the Department of Homeland Security can simply turn to data brokers and purchase mass amounts of Americans\u2019 data.\u201d<\/p>\n\n\n\n<p>Ms. Hageman noted that the information obtained by the federal government from data brokers includes personal information obtained by tracking Americans at their places of worship and at protests.<\/p>\n\n\n\n<p>Rep. Jerrold Nadler (D-N.Y.) likewise said the bill had broad bipartisan support, noting that it was approved to move to the floor in a rare unanimous committee vote.<\/p>\n\n\n\n<p>\u201cWe have the Fourth Amendment for a reason. If law enforcement wants to gather information about you, they should first obtain a warrant. They should have to go to a judge and explain why there\u2019s probable cause and why they need to know this information.\u201d<\/p>\n\n\n\n<p>\u201cThat anyone should have Americans\u2019 private information is highly troubling to me,\u201d Mr. Nadler said. \u201cThat our federal government can obtain it without a warrant should be troubling to all of us.\u201d<\/p>\n\n\n\n<p>The Biden administration and senior intelligence leaders have <a href=\"https:\/\/www.theepochtimes.com\/us\/intelligence-leaders-implore-congress-not-to-end-surveillance-law-5605393\" target=\"_blank\" rel=\"noreferrer noopener\">fought against<\/a> any effort to reform the government\u2019s expansive intelligence collection apparatus that would mandate it obtain warrants to purchase information.<\/p>\n\n\n\n<p>The saga follows the <a href=\"https:\/\/www.theepochtimes.com\/us\/nsa-buying-illegally-sourced-data-on-americans-without-warrants-5574602\" target=\"_blank\" rel=\"noreferrer noopener\">January release<\/a> of correspondence between Sen. Ron Wyden (D-Ore.) and the Department of Defense, which outlined that the National Security Agency (NSA) is buying Americans\u2019 personal information from data brokers en masse without obtaining warrants.<\/p>\n\n\n\n<p>The data the government is purchasing includes data that was illegally obtained by the data brokers it is purchasing from.<\/p>\n\n\n\n<p>\u201cThe U.S. government should not be funding and legitimizing a shady industry whose flagrant violations of Americans\u2019 privacy are not just unethical, but illegal,\u201d Mr. Wyden wrote at the time.<\/p>\n\n\n\n<p>The letters revealed that the DoD and its intelligence-related wings have effectively been circumventing Americans\u2019 Fourth Amendment rights by using commercial means to obtain private information without the warrants that would be required to obtain such data from service providers.<\/p>\n\n\n\n<p>Records purchased from data brokers by the federal government include IP addresses, metadata, and geolocation data, among other things, which can reveal what websites Americans visit, what apps they use, and even their personal medical histories.<\/p>\n\n\n\n<p>Gen. Paul Nakasone, who serves as director for the NSA, argued at that time that the Fourth Amendment does not protect Americans\u2019 information if it is commercially available, even if it was obtained by the seller illegally.<\/p>\n\n\n\n<p>That statement is built on the DoD\u2019s interpretation of Carpenter v. United States, a 2018 Supreme Court case that found the government could not obtain Americans\u2019 cellphone location data and other information from service providers without a warrant.<\/p>\n\n\n\n<p>President Joe Biden <a href=\"https:\/\/www.theepochtimes.com\/us\/biden-to-sign-eo-restricting-adversarial-nations-from-purchasing-americans-data-5596794\" target=\"_blank\" rel=\"noreferrer noopener\">signed an executive order<\/a> in February to prevent hostile nations from purchasing the sensitive data of U.S. residents through legal sources, but has maintained the United States must retain the ability to combat terrorism.<\/p>\n\n\n\n<p>A Jan. 9<a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/01\/ftc-order-prohibits-data-broker-x-mode-social-outlogic-selling-sensitive-location-data\" target=\"_blank\" rel=\"noreferrer noopener\"> FTC finding<\/a> ruled, however, that data brokers must be prohibited from sharing or selling any sensitive location data after determining that many apps collecting these types of data were obtained illegally, with the individual using the app never being informed or consenting to have their personal information sold to the government.<\/p>\n\n\n\n<p>As such, the legality of the practice is now an issue of some contention.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The timing of this seems highly suspect when they&#8217;ve just passed the FISA legislation in the House of Representatives which expands the federal government&#8217;s illegal spying on American citizens.
