Ron Wyden is questioning the legality of a White House program that enables law enforcement to access trillions of phone records, according to a letter to the Department of Justice (DOJ) published on Monday.<\/p>\n\n\n\n<p>Wyden is pushing the DOJ to publish information on a program called Data Analytical Services (DAS), previously known as Hemisphere, for public transparency, <a href=\"https:\/\/www.wyden.senate.gov\/imo\/media\/doc\/wyden_hemisphere_surveillance_letter_112023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to the letter. The White House Office of National Drug Control Policy (ONDCP) has paid AT&amp;T over $5 million for Americans\u2019 records, frequently without a warrant, since 2009, in what Wyden says may be an illegal program.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>I plan to vote against any continuing resolution that extends FISA Section 702 without meaningful reforms. Massive, privacy-violating surveillance programs cannot be rushed through without reform or review.<\/p>\n\n\n\n<p>\u2014 Ron Wyden (@RonWyden) <a href=\"https:\/\/twitter.com\/RonWyden\/status\/1724166291185910158?ref_src=twsrc%5Etfw\">November 13, 2023<\/a><\/p>\n<\/blockquote>\n\n\n\n<p>\u201cI have serious concerns about the legality of this surveillance program, and the materials provided by the DOJ contain troubling information that would justifiably outrage many Americans and other members of Congress,\u201d Wyden wrote in the letter.<\/p>\n\n\n\n<p>The program allows law enforcement to access the details of Americans\u2019 call and analyze the phone records of citizens, even if they are not suspected of committing a crime. Wyden characterized the program as giving law enforcement&nbsp; \u201cthe ability to request often-warrantless searches of trillions of domestic phone records. \u201d<\/p>\n\n\n\n<p>Despite DAS receiving funding from the White House\u2019s ONDCP, a leaked file from the Northern California Regional Intelligence Center reveals local police bureaus asked for DAS information for cases that appeared not to be related to drugs, WIRED <a href=\"https:\/\/www.wired.com\/story\/hemisphere-das-white-house-surveillance-trillions-us-call-records\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>.<\/p>\n\n\n\n<p>\u201cWe obtained six months of call data for [suspect]\u2019s phone, as well as several close associations (his girlfriend, father, sister, mother),\u201d an officer wrote in a request for information, according to WIRED.<\/p>\n\n\n\n<p>The DOJ gave Wyden\u2019s office numerous pages of information about the program in 2019, which he wants the DOJ to release, according to his letter.<\/p>\n\n\n\n<p>\u201cThis surveillance program is not classified,\u201d Wyden wrote. \u201cThe public interest in an informed debate about government surveillance far outweighs the need to keep this information secret.\u201d<\/p>\n\n\n\n<p>\u201cThis is a long-running dragnet surveillance program in which the White House pays AT&amp;T to provide all federal, state, local, and Tribal law enforcement agencies the ability to request often-warrantless searches of trillions of domestic phone records,\u201d Wyden wrote<\/p>\n\n\n\n<p>Since \u201cobscure\u201d grants fund the program rather than funds coming directly from a particular agency, it evades the typical federal privacy evaluation, according to the letter.<\/p>\n\n\n\n<p>The New York Times first <a href=\"https:\/\/www.nytimes.com\/2013\/09\/02\/us\/drug-agents-use-vast-phone-trove-eclipsing-nsas.html\" target=\"_blank\" rel=\"noreferrer noopener\">uncovered<\/a> the program, referring to it as the Hemisphere Project, in 2013. A law enforcement official characterized it as \u201cAT&amp;T\u2019s Super Search Engine\u201d and \u201cGoogle on Steroids,\u201d <a href=\"https:\/\/www.eff.org\/deeplinks\/2016\/11\/law-enforcements-secret-super-search-engine-amasses-trillions-phone-records\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to documents obtained from the Drug Enforcement Administration through Freedom of Information Act lawsuits by Electronic Frontier Foundation in 2016.<\/p>\n\n\n\n<p>Wyden is part of a bipartisan coalition of lawmakers that recently introduced the&nbsp;<a href=\"https:\/\/lofgren.house.gov\/sites\/evo-subsites\/lofgren.house.gov\/files\/evo-media-document\/11.7.23-full-text-government-surveillance-reform-act_gsra.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Government Surveillance Reform Act<\/a> to reform Section 702 of the Foreign Intelligence Surveillance Act (FISA), which also <a href=\"https:\/\/www.google.com\/url?client=internal-element-cse&amp;cx=013858372769713515008:m9uq4uupsfm&amp;q=https:\/\/dailycaller.com\/2017\/06\/28\/intel-agencies-still-havent-told-the-house-how-many-americans-are-surveilled\/&amp;sa=U&amp;ved=2ahUKEwiIpJ6Orc3-AhXRM1kFHRrbBqIQFnoECAkQAg&amp;usg=AOvVaw0F7NQA35DIwn2pg1fV9gBf\" target=\"_blank\" rel=\"noreferrer noopener\">enables<\/a>&nbsp;U.S. intelligence agencies to&nbsp;<a href=\"https:\/\/dailycaller.com\/2023\/04\/27\/doj-inspector-general-has-no-answer-to-how-many-in-government-can-spy-on-americans-through-backdoor-searches\/\" target=\"_blank\" rel=\"noreferrer noopener\">surveil<\/a> American citizens without a warrant.<\/p>\n\n\n\n<p>The White House, DOJ and AT&amp;T did not immediately respond to the Daily Caller News Foundation\u2019s request for comment.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>It&#8217;s getting hard to keep track of all the many ways our government violates our constitution and the oath they took to uphold it.
