And throw in this faulty tech with understaffed law enforcement, and there will be a lot more unlawful arrests and subsequent lawsuits. Source: Shutterstock<\/figcaption><\/figure>\n\n\n\n<h5 class=\"wp-block-heading\">Department of Injustice<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Jalil Richardson of North Carolina is free after spending over 50 days in jail after being wrongfully arrested for a crime he did not commit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According <a href=\"https:\/\/www.actionnewsjax.com\/news\/local\/man-wrongfully-jailed-prosecutors-cite-facial-recognition-match-before-dropping-case\/CJBWGL47CVEFJDFBJWQ3XHBNZU\/\" rel=\"noreferrer noopener\" target=\"_blank\">to <em>Action News Jax<\/em><\/a>, Richardson was initially accused of stealing a vehicle in Jacksonville, Florida, after police fed surveillance video from a private business into their AI-integrated facial recognition system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The system then identified Richardson with what it said was an 85 percent facial recognition match, the Florida attorney\u2019s office told <em>Jax<\/em>. Paired with two \u201ceyewitness\u201d accounts, it was enough to establish probable cause against Richardson, even though he\u2019d been clocked into his job hundreds of miles away when the crime took place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After being arrested and made to spend nearly two months in custody, Richardson and his lawyers were finally able to establish his alibi in court, forcing prosecutors to drop the case \u2014 an infuriating miscarriage of justice, and quite possibly a sign of things to come as cops across the country embrace flawed facial recognition systems as a shortcut to investigating crimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere was no proper investigation done to even reach out to me or to see if I was even in Florida,\u201d Richardson told <em>Jax<\/em>. \u201cAnd I sat in there for over 50 days in the most worst jail ever.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wrongful arrests based on AI facial recognition software are becoming something of a pattern with the Jacksonville Sheriff\u2019s Office. Their first victim was <a href=\"https:\/\/futurism.com\/police-facial-recognition-random-arrest\">Robert Dillon<\/a>, a \u201c93 percent match\u201d who was wrongfully accused of attempting to lure and kidnap a 12-year-old child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Like Richardson, Dillon was a world away at the time \u2014 a five hour drive on the other side of the state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to privacy litigation director for the Electronic Frontier Foundation Adam Schwartz, it\u2019s the 14th known case of a wrongful arrest due to facial recognition software.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe technology is simply too dangerous for law enforcement to be using at all,\u201d Schwartz told <em>Jax<\/em>. \u201cMore than a dozen innocent people have been arrested by police because of errors with face recognition. These errors, majority, are people of color. The largest group of them is Black people.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Though the Jacksonville Sheriff\u2019s Office rejects \u201cany assumption that the technology discriminates against any specific skin tones,\u201d evidence to the contrary is <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/aug\/08\/facial-recognition-technology-discriminates-against-people-of-colour\" rel=\"noreferrer noopener\" target=\"_blank\">increasingly<\/a> <a href=\"https:\/\/futurism.com\/police-facial-recognition-nypd\">difficult<\/a> to deny. Though the Sheriff\u2019s office refuses to take any responsibility, their wrongful arrest has all but destroyed Richardson\u2019s previous life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On top of losing his job \u2014 no working class person can miss two months and hope to stay on the payroll \u2014 Richardson told <em>Jax<\/em> he lost his home, as well as custody of two of his kids.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m not sure how I\u2019m gonna bounce back from this one, you know,\u201d he told reporters. \u201cIt\u2019s a lot.
