Kyrsten Sinema was recently sued for allegedly&nbsp;<a href=\"https:\/\/thefederalist.com\/2026\/01\/27\/stay-at-home-mom-stands-up-to-alleged-homewrecker-and-ex-senator-kyrsten-sinema\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrecking<\/a>&nbsp;a long-term marriage with three children, six states sanctioned lawsuits for alienation of affections by abandoned spouses. The number has since dropped to five states, with Utah legislators poised to&nbsp;eliminate&nbsp;their law any day.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Suits for alienation of affections allow separated and divorced spouses to bring a civil action for monetary damages against a third party who intentionally causes or contributes to the destruction of an otherwise happy marriage. Anyone who interferes with the marriage in that manner can be sued, but the&nbsp;defendant&nbsp;is&nbsp;typically the&nbsp;affair&nbsp;partner of an estranged spouse. The damages&nbsp;sought&nbsp;can be compensatory (for emotional distress and loss of consortium), punitive (to punish the wrongdoer and deter further wrongdoing), or both.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The devastating&nbsp;<a href=\"https:\/\/thefederalist.com\/2025\/07\/23\/the-coldplay-cuddlers-arent-the-only-ones-destroying-families\/\" target=\"_blank\" rel=\"noreferrer noopener\">effects<\/a>&nbsp;infidelity and marital breakdown have on families and communities can no longer be seriously challenged. So why are courts and legislators so eager to abolish these laws and strip the last vestiges of protection for innocent spouses and children?&nbsp;&nbsp;<\/p>\n\n\n\n<p>On Jan. 26, 2026, the&nbsp;<a href=\"https:\/\/nmonesource.com\/nmos\/nmsc\/en\/item\/537798\/index.do\" target=\"_blank\" rel=\"noreferrer noopener\">New Mexico Supreme Court<\/a>&nbsp;unanimously abolished New Mexico\u2019s common law tort for alienation of affections, wiping out 103 years of protection. The court recognized the cause of action had always been available without regard to&nbsp;sex, but&nbsp;was nevertheless offended by the law\u2019s so-called \u201cpatriarchal origins,\u201d which&nbsp;ostensibly considered&nbsp;women property. If that\u2019s sound reasoning, why not strike down other laws that have been extended to women?&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>The court further called the law \u201cdehumanizing\u201d because it&nbsp;purportedly presumed&nbsp;a \u201cspouse&nbsp;has&nbsp;<em>no agency&nbsp;<\/em>regarding to whom they give their affections,\u201d wrongfully taking marital \u201cinterlopers to task for effectively&nbsp;<em>stealing&nbsp;<\/em>the affections of the spouse just as one might steal an inanimate object.\u201d Translation: Breaking up a marriage can be analogized to, say, stealing a candy bar from a&nbsp;corner&nbsp;deli.&nbsp;Clearly, cheaters&nbsp;and paramours need more defending than&nbsp;<a href=\"https:\/\/supremecourt.nmcourts.gov\/wp-content\/uploads\/sites\/2\/2025\/06\/Answer-Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">victims<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The couple in the New Mexico&nbsp;<a href=\"https:\/\/supremecourt.nmcourts.gov\/wp-content\/uploads\/sites\/2\/2025\/06\/Brief-in-Chief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;had married in 2007, had children, and divorced in 2022. Ex-husband James Butterworth claimed that his wife and her boyfriend met at a party, after which the boyfriend aggressively pursued his wife, leading to the break-up. Butterworth\u2019s wife intervened in the action, alleging her boyfriend\u2019s extra-marital&nbsp;attentions were&nbsp;not unwelcome. She objected to providing evidence of their communications, claiming an invasion of her privacy.&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>In denying Butterworth relief, the court held that filing a no-fault divorce action was the proper remedy for abandoned spouses. It&nbsp;opined that by adopting no-fault, New&nbsp;Mexico legislators signaled an intent to&nbsp;\u201cavoid inquiry into what had gone wrong in a marriage.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>But what if an innocent spouse wants to save the marriage? Infidelity is devastating, but&nbsp;<a href=\"https:\/\/www.gottman.com\/blog\/practical-science-based-steps-to-heal-from-an-affair\/\" target=\"_blank\" rel=\"noreferrer noopener\">reconciliations<\/a>&nbsp;do occur, especially when affair partners are willing to bow out. And if fault is irrelevant in a no-fault divorce, how does an innocent spouse then&nbsp;recover for&nbsp;the harm of infidelity?&nbsp;&nbsp;<\/p>\n\n\n\n<p>Several years earlier, this very same court gushed over the rights and protections allegedly denied to&nbsp;<a href=\"https:\/\/law.justia.com\/cases\/new-mexico\/supreme-court\/2013\/34-306.html\" target=\"_blank\" rel=\"noreferrer noopener\">same-sex couples<\/a>&nbsp;and the attendant harm to the \u201cstability\u201d of relationships.&nbsp;Apparently, some&nbsp;relationships are more worthy of safeguarding in New Mexico than others.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Counsel for Butterworth, Gary Boyle, told me his client has not yet decided whether to appeal.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>In January, Republican state Sen. Todd Weiler introduced a&nbsp;<a href=\"https:\/\/www.billtrack50.com\/billdetail\/1924692\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a>&nbsp;to&nbsp;eliminate&nbsp;the alienation of affections law in Utah. In one week, the bill was reported out of committee, approved by the Senate, and shipped to the House. The state has one of the nation\u2019s shortest legislative&nbsp;<a href=\"https:\/\/le.utah.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">sessions<\/a>, known for fast-tracking legislation.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Greg Hughes, former Speaker of the Utah House, who now co-hosts a popular radio talk&nbsp;<a href=\"https:\/\/www.spreaker.com\/episode\/the-rod-and-greg-show-utah-s-alienation-of-affection-law-in-jeopardy-how-utah-works-with-ice--69675984\" target=\"_blank\" rel=\"noreferrer noopener\">show<\/a>, was flabbergasted to learn of the legislation.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cAre they trying to hide something?\u201d&nbsp;he&nbsp;asked me. \u201cI\u2019m&nbsp;not a public servant any longer, but wouldn\u2019t there be an optics issue if you were trying to get rid of that provision as a lawmaker? \u2026&nbsp;We\u2019re&nbsp;trying to defend the family over here. This is accountability. You want to be a&nbsp;homewrecker,&nbsp;you ought to face some justice.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>Alan Hawkins, professor emeritus at Brigham Young University, family and marriage expert, and former chair of the&nbsp;<a href=\"https:\/\/extension.usu.edu\/strongermarriage\/about-contact\" target=\"_blank\" rel=\"noreferrer noopener\">Utah Marriage Commission<\/a>,&nbsp;wasn\u2019t&nbsp;aware of the bill either.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cAlthough some judges don\u2019t want to see the action argued in their courtrooms, I think it would be best to leave it on the books,\u201d he told me. \u201cFamily instability is the most important social issue of our time. The research shows how beneficial good marriages are&nbsp;to&nbsp;adults, children, and communities.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>But Sen. Weiler&nbsp;<a href=\"https:\/\/utahnewsdispatch.com\/2026\/01\/12\/utah-legislature-to-consider-abolishing-alienation-of-affection-lawsuits\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;the law disrespects the free will of spouses \u201cwho have decided to move on to a different relationship.\u201d&nbsp;He\u2019s&nbsp;\u201c<a href=\"https:\/\/www.youtube.com\/watch?v=9-IvYt4E9ak\" target=\"_blank\" rel=\"noreferrer noopener\">most<\/a>\u201d offended by the origins of the law that&nbsp;he said&nbsp;categorized&nbsp;women&nbsp;as&nbsp;property&nbsp;\u2014&nbsp;a claim right out of a feminist&nbsp;<a href=\"https:\/\/ifstudies.org\/blog\/attacks-on-conservatives-supporting-divorce-reform-are-mounting\" target=\"_blank\" rel=\"noreferrer noopener\">playbook<\/a>. He&nbsp;also pointed to unspecified cases of alleged \u201c\u2018vengeful\u2019 litigation\u201d that influenced his mission to squash the law.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Which ones? The $10&nbsp;<a href=\"https:\/\/utahnewsdispatch.com\/2026\/01\/12\/utah-legislature-to-consider-abolishing-alienation-of-affection-lawsuits\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;against the Mormon Church? The bombshell pending lawsuit against a wealthy Utah real estate&nbsp;<a href=\"https:\/\/nypost.com\/2026\/01\/30\/us-news\/married-real-estate-mogul-offered-subordinate-multi-million-dollar-indecent-proposal-to-leave-her-husband-for-him-lawsuit\/?utm_medium=social&amp;utm_campaign=nypost&amp;utm_source=facebook&amp;fbclid=IwdGRzaAPptG1jbGNrA-mzk2V4dG4DYWVtAjExAHNydGMGYXBwX2lkDDM1MDY4NTUzMTcyOAABHvEKVc-wsAfivQMek4QoWF7KzHmutI3UTjTuwhl2Nbp7S3iayB9IJ-P-LkcW_aem_ES8p5lQpTCoNR8kYN-X86A\" target=\"_blank\" rel=\"noreferrer noopener\">mogul<\/a>&nbsp;who has been accused of offering another man\u2019s wife $1.5 million \u2014 documented in writing \u2014 to leave her husband, around the same time he left his wife?&nbsp;The female contractor eventually left her marriage too, but says her decision was unrelated to the mogul\u2019s proposal.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Sen. Weiler claims he&nbsp;doesn\u2019t&nbsp;\u201cnecessarily want to protect\u201d&nbsp;people who cheat on their spouses.&nbsp;But isn\u2019t that exactly what he and his colleagues in the Utah legislature are doing? So much for Utah\u2019s claim to be&nbsp;\u201cthe most&nbsp;<a href=\"https:\/\/governor.utah.gov\/strengthening-families\/\" target=\"_blank\" rel=\"noreferrer noopener\">family-friendly<\/a>&nbsp;state in the nation.\u201d &nbsp;&nbsp;<\/p>\n\n\n\n<p>Sen. The law&nbsp;still appears to be&nbsp;strong in North Carolina, where Sinema is being sued, but there have been repeated&nbsp;<a href=\"https:\/\/ncfamily.org\/house-committee-rejects-bill-that-would-effectively-legalize-adultery-in-nc\/\" target=\"_blank\" rel=\"noreferrer noopener\">attempts<\/a>&nbsp;to&nbsp;<a href=\"https:\/\/lrs.sog.unc.edu\/billsum\/s-626-2025-2026\" target=\"_blank\" rel=\"noreferrer noopener\">repeal it.<\/a>&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Despite legal and legislative&nbsp;<a href=\"https:\/\/www.sdnewswatch.org\/despite-controversy-alienation-of-affection-cases-still-filed-in-s-d\/\" target=\"_blank\" rel=\"noreferrer noopener\">outcries<\/a>&nbsp;against&nbsp;such laws in South Dakota, in 2018 the state\u2019s Supreme Court <a href=\"https:\/\/law.justia.com\/cases\/south-dakota\/supreme-court\/2018\/28441.html\" target=\"_blank\" rel=\"noreferrer noopener\">held<\/a>&nbsp;that alienation of actions&nbsp;remains&nbsp;firmly entrenched. Lawsuits in&nbsp;<a href=\"https:\/\/law.justia.com\/cases\/hawaii\/supreme-court\/1979\/6197-2.html\" target=\"_blank\" rel=\"noreferrer noopener\">Hawaii<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.perrylawfirmllcms.com\/blog\/2023\/04\/mississippi-supreme-court-rules-on-alienation-of-affection\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mississippi<\/a>&nbsp;are&nbsp;rare,&nbsp;but they&nbsp;remain&nbsp;viable&nbsp;causes of action there too.
