You&#8217;d have to think these justices are beholden to someone and got their marching orders.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.zerohedge.com\/political\/wyoming-supreme-court-rules-abortion-may-stay-legal-due-obamacare-amendment\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.zerohedge.com\/political\/wyoming-supreme-court-rules-abortion-may-stay-legal-due-obamacare-amendment<\/a><\/p>\n\n\n<div class=\"wp-block-ub-divider ub_divider ub-divider-orientation-horizontal\" id=\"ub_divider_ddf89c3d-1279-4c20-ad50-8445b55f04ee\"><div class=\"ub_divider_wrapper\" style=\"position: relative; margin-bottom: 2px; width: 100%; height: 2px; \" data-divider-alignment=\"center\"><div class=\"ub_divider_line\" style=\"border-top: 2px solid #ccc; margin-top: 2px; \"><\/div><\/div><\/div>\n\n\n<p>By Arjun Singh via The Epoch Times<\/p>\n\n\n\n<p>The Supreme Court of Wyoming, on Jan. 6, ruled that <strong>two state laws banning the procedure and the availability of abortion medication were unconstitutional.<\/strong><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/image%2828%29_3.jpg?itok=RuxEkc6a\"><\/a><\/p>\n\n\n\n<figure class=\"wp-block-image alignright\"><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/image%2828%29_3.jpg?itok=RuxEkc6a\"><img decoding=\"async\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/image%2828%29_3.jpg?itok=RuxEkc6a\" alt=\"\"\/><\/a><\/figure>\n\n\n\n<p>The court, in the case of <a href=\"https:\/\/documents.courts.state.wy.us\/Opinions\/S-24-0326%20State%20v.%20Johnson%20Final.pdf\">State v. Johnson<\/a>, held that <strong>the two laws<\/strong> in question\u2014the Life is a Human Right Act of 2023, which bans abortion procedures, and the state\u2019s abortion drug ban\u2014<strong>violated Article 1, Section 38 of the Constitution of Wyoming<\/strong>. That provision of the state constitution was added by a statewide referendum in 2012, which states, \u201cEach competent adult shall have the right to make his or her own health care decisions.\u201d<\/p>\n\n\n\n<p>\u201cAll five Wyoming Supreme Court justices agreed that the decision whether to terminate or continue a pregnancy is a woman\u2019s own health care decision protected by Article 1, Section 38,\u201d wrote the court in a summary of its opinion and announcement of the decision.<\/p>\n\n\n\n<p>The court added that \u201c<strong>all five justices also concluded that an adult\u2019s right to make his or her own health care decisions is a fundamental right<\/strong> because of the very specific language used,\u201d even though the referendum was passed in response to the Patient Protection and Affordable Care Act, known more commonly as \u201cObamacare.\u201d<\/p>\n\n\n\n<p>The court, however, split four to one on deciding whether the laws in question could be struck down.<\/p>\n\n\n\n<p>\u201c<strong>Four justices (Boomgaarden, Fox, Jarosh, and Fenn) voted to strike down the 2023 abortion laws. <\/strong>Justice Gray voted to uphold the laws,\u201d the court\u2019s summary read.<\/p>\n\n\n\n<p>The court noted that even though Article 1, Section 38 was passed in response to Obamacare, the language of the provision was inflexible, writing, \u201cThe Court recognized it cannot add words to the Wyoming Constitution. &#8230; But lawmakers could ask Wyoming voters to consider a constitutional amendment that would more clearly address this issue.\u201d<\/p>\n\n\n\n<p>Lower courts, when reviewing the case, also struck down the laws.<\/p>\n\n\n\n<p>Wyoming is a heavily conservative state that is dominated by the Republican Party, and pro-life sentiment is widespread. Following the ruling, Governor of Wyoming Mark Gordon called for a referendum to amend the constitution and invalidate the ruling.<\/p>\n\n\n\n<p><strong>\u201cThis ruling may settle, for now, a legal question, but it does not settle the moral one<\/strong>, nor does it reflect where many Wyoming citizens stand, including myself. It is time for this issue to go before the people for a vote,\u201d Gordon wrote in a <a href=\"https:\/\/x.com\/GovernorGordon\/status\/2008631723819708621?s=20\">statement<\/a> published on social media. \u201cI call on the legislature to pass and place a clear constitutional amendment on my desk.\u201d<\/p>\n\n\n\n<p>The lead plaintiff in the case, Wellspring Health Access in Casper, Wyoming, celebrated the ruling.<\/p>\n\n\n\n<p>\u201cOur clinic will remain open and ready to provide compassionate reproductive health care, including abortions, and our patients in Wyoming will be able to obtain this care without having to travel out of state,\u201d said Julie Burkhart, the organization\u2019s president, in a <a href=\"https:\/\/wellspringaccess.org\/blog\/wellspring-wy-sc-ruling-statement-1-6\/\">statement<\/a>.<\/p>\n\n\n\n<p><em>The Associated Press contributed to this report.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>What about the baby&#8217;s right not to be murdered?
